A homeowner on Holiday Hills Circle said he fired shots when he found burglary suspects inside his home and one appeared to be going for a gun.

Police arrested Nico Bates and charged him with aggravated burglary, possession of a weapon while in the commission of a felony, theft of property over $1,000, and possession of a firearm with intent to go armed.

The homeowner at the time said all the suspects were still on the scene.

When police arrived, they saw a female in a red Chrysler pulling away toward Bonny Oaks Drive, while two others fled on foot toward Wimberly Drive.

Officers on foot and in a patrol vehicle tried to apprehend the suspects. One, later identified as Bates, was seen with a handgun. The gun was later found in some bushes.

An officer came up behind Bates and held a gun on him, ordering him to surrender.

Bates said, "I didn't take anything out of that house."

The homeowner identified Bates as one of the people inside his house. He said he was holding one of his TVs.

There were three TVs and two laptops taken.
