Woman Testifies About Being Shot, Then Is Taken Into Custody

  • Tuesday, November 10, 2015

A woman testified Tuesday about being shot on the parking lot of the Hixson Walmart on Sept. 28, then she was taken into custody.

General Sessions Court Judge Gary Starnes said Mercedes Stalyon had a prior failure to appear in court and a petition to revoke a prior sentence. He said she failed a prior drug screen, and he said two needles and drugs were found in her car.

The judge bound to the Grand Jury charges against Anthony Lee Mullis, 21, and Benjamin James Murphy, 29, in the shooting.

Police said there were text messages between Ms. Stalyon and Mullis over a meeting for the sale of some "roxies" (oxycodone).

Ms. Stalyon said after she pulled up at the parking lot she saw Mullis come over. Then Murphy opened the passenger door and aimed a gun at her.

She said he demanded money. She said she had inherited $15,000 from an older man she married in 2013, who later died. But she said she only had about $40 with her at the time.

She said the gunman reached for her car keys with his left hand. She was shot in the hip as she struggled over the keys.

Police said there was video of much of the incident, but not the actual shooting.

A shell casing and the victim's cell phone were found at the scene.

Bond was set for $85,000 on Mullis and $440,000 on Murphy.

The judge ordered two prior consecutive 11-month and 29-day sentences against Mullis into execution.

Lance Pope is prosecuting the case.
