Man Who Pulls Gun After Being Upset At Noisy Wendy's Customer Arrested In East Ridge

A 70-year-old Ringgold man who allegedly pulled a gun on employees of a Wendy's restaurant on Ringgold Road after becoming upset about a noisy customer has been arrested.

Ernest Cummings was charged with two counts of aggravated assault.

In the incident on Saturday at approximately 4 p.m., East Ridge Police responded to Wendy's at 6727 Ringgold Road in reference to a disorder with a weapon. Restaurant staff told police the suspect had asked for the removal of another patron who he believed to be making too much noise in the store.

After management refused to remove the person, Cummings became angry, exited the store and entered his vehicle. He then drove to the drive-thru window, exited his vehicle and shoved a tray of food and other garbage through the window while cursing.

Police said he then retrieved a handgun from the vehicle and pointed it at two of the store employees. The suspect then left the scene; however, officers were able to detain him approximately two blocks away.

A .40 caliber handgun was recovered from the vehicle.

Cummings was transported to the Hamilton County Jail.

He is scheduled to appear in East Ridge Municipal Court on Tuesday, July 24, at 5 p.m.
