Federal Appeals Court Upholds State's Death By Legal Injection

The 6th U.S. Circuit Court of Appeals on Thursday overturned a lower court ruling that Tennessee's method of execution by lethal injection was unconstitutional.

The federal district court in 2007 in a case involving a Chattanooga man had ruled that it was unconstitutional because the process involved "unnecessary infliction of pain."

The appeal was from Edward Jerome Harbison, who was sent to Death Row for the murder of a St. Elmo woman.

At the same time, the Federal Appeals Court overturned an injunction that was blocking the execution of Harbison.

The U.S. Supreme Court had recently upheld use of lethal injection in Kentucky.
