Jury Clears Officer Penny In Tasing Case posted March 26, 2008 A Federal Court jury deliberated for an hour late Wednesday morning before clearing Chattanooga Police Officer Curtis Penny of all charges in a tasing case. Ashley Johnson, of Rocky Face, Ga., had sued the city for $100,000 over an incident on Halloween night 2004 at Chattanooga Food and Drink on Brainerd Road. He denied resisting when he was ordered out of the club, and he said he was repeatedly tased by Officer Penny. City witnesses said Mr. Johnson was removed from the club for grabbing the rear end of a cute female who walked past him and said he swung his arms and kicked and also reached in his pocket as he was escorted out. City witnesses said they believed he might be going for a gun. It turned out he had a pocket knife, but no gun. The city was represented by Phil Noblett and Crystal Freiberg. Judge Curtis Collier presided over the three-day case. |
