Police said a man who was shot on Sunday morning in East Lake was assaulting the woman who shot him and others immediately before the gunfire.

Police said 29-year-old Latesha Hinton would not be charged in the shooting of Dieshunn Lindsey, 30.

At approximately 10:50 a.m., officers with the Chattanooga Police Department responded to the 2700 block of 6th Ave Court on a person shot.

Upon arrival, Chattanooga Police found Lindsey suffering from a non-life threatening gunshot wound.

Hamilton County EMS responded to the scene to transport Lindsey to a local hospital for further treatment.

The investigation determined the actual crime scene to be at the 2000 block of Duncan Avenue.

Police said, "The shooting appears to have resulted during a disorder between Mr. Lindsey and Latesha Hinton, both of whom were available to speak with investigators."

Investigators were able to determine that Ms. Hinton reasonably feared for herself and the others nearby and shot Mr Lindsey in self defense, police said.

Lindsey was arrested on unrelated outstanding warrants. Charges against him for this incident are pending.  The pending charges include two counts of aggravated assault and five counts of reckless endangerment.
