Bar Association Asks Appointment Of Receiver To Handle Cases Of Chattanooga Attorney Who Was Shot In Catoosa County

The Chattanooga Bar Association is asking for a receiver to handle the cases of a Chattanooga attorney who was shot and arrested in a bizarre incident in Catoosa County, Ga., on July 12.

The filing in Circuit Court asks that a judge name an attorney to close out the cases of Matthew Jack Fitzharris.

The bar association said Fitzharris "is diabled and unable to practice law at this time."

The filing said he "has been unable to make arrangements for another attorney to handle his cases."

It says Fitzharris was handling a number of cases and did not have a law partner.

The petition was filed by attorney Bill Colvin.

Fitzharris wound up shot in the arm after breaking into a couple's home.

The lawyer, who has an office on Georgia Avenue, faces a variety of charges after the incident.

Police said he threatened the couple, then threw plants at them. They said he refused to leave.

Fitzharris was charged with two counts of aggravated assault, two counts of terroristic threats, two counts of entering an automobile or other motor vehicle with intent to commit theft or felony, burglary, simple assault and criminal damage to property.

Alice Hanshaw said Fitzharris showed up inside their home on 1019 Cloud Springs Road, carrying a blanket with him. She said when he was told to leave, he responded, "I'm not leaving your (expletive) house."

After 911 was called, Fitzharris went outside and up some stairs to an apartment where the couple's niece lives. When they shouted for him to come down, he threw potted plants at them.

The couple said the attorney was shot after he lunged at them following the firing of a warning shot.

He was found by police in his car suffering from the gunshot wound.
