Charges were bound to the Grand Jury on Tuesday against Kenneth Dixon, Jr., 29, in connection with a March 1 shooting that left a man with a bullet in his leg.
However, charges were dismissed against Milton Evans Jr., 29. Judge Gary Starnes said there was no proof against him.
Police had said Dixon and Evans were seen fleeing in a black Jeep from the 2000 block of Rawlings St., where Marcus Fortson was wounded.
Police said the victim had gotten into a verbal altercation, then a shot was fired.
Evans, who was represented by attorney Jonathan Turner, had been charged with aggravated robbery, unlawful possession of a firearm and criminal conspiracy.
Dixon is now charged with aggravated assault, aggravated robbery and unlawful possession of a weapon.
Lakesha Roseberry said Dixon fired the shot and then rummaged through the victim's pockets as he lay on the ground.
Fortson said he was missing $700 after the incident.
He said he does not drink often, but had been drinking all night with his lady friend. He said he drank "three or four bottles" and he does not remember the incident.
He said he had to undergo surgery and had a rod inserted in his leg. He is still on strong pain medication.
