Chattanooga Police Officer Resigns Before Being Fired On Charges Of Misconduct And Theft

Kevin Kincer submitted his resignation with the Chattanooga Police Department on Monday.

Kincer was placed on administrative leave on Dec. 17,  2014, pending charges of three counts of official misconduct and three counts of theft.

After a complete review of the investigation, which included recommendations from Internal Affairs, the Administrative Review Committee and Sgt. Kincer’s chain of command, Chief of Police Fred Fletcher sustained the following violations:

·         Code of Conduct – Unbecoming Conduct

·         Conformance to Law

·         Improper Procedures - Property

·         Ethics

Officials said, "Chief Fletcher likely would have terminated Mr. Kincer following today’s disciplinary hearing. However, Officer Kincer officially resigned this morning prior to the previously scheduled disciplinary hearing."

In light of the sustained violations and Kincer’s resignation, Chief Fletcher will be requesting a decertification of Kincer’s Peace Officer Standards and Training Commission (POST) certification as a qualified police officer.
