Charges Upgraded Against Avery To Murder After Victim of Chair Leg Attack At Moccasin Bend Dies

Charges have been upgraded to murder against Leviticus Avery, 37, after a man he allegedly attacked with a chair leg has died.

Avery initially was charged with aggravated assault and attempted first-degree murder in the incident last Thursday at the Moccasin Bend Mental Health facility.

Kevin Green, 38, remained in critical condition until he died.

He was struck in the head with the chair leg, police said.

He is an inmate at the Hamilton County Jail.

The warrants were served on Avery at the Hamilton County Jail.

    The officer who responded to the incident said that the victim suffered major brain trauma and bleeding and had very little chance of survival.

 

A surveillance video which captured the assault allegedly shows the defendant walking around the lobby yelling at other patients before turning a wooden table over and removing one of its legs.

 

In the video the defendant then begins to hit the safety glass at the front desk with the leg and walks over to the nurses station. At this point he is joined by the victim who stands next to him before he is struck on the side of the head with the leg.
