Museum Bluffs Condo Owner Sues Association, Owner

An owner at the Museum Bluffs Parkview Condos on Walnut Street has sued the condo association and owner.

Daniel J. Laughlin filed the Circuit Court lawsuit against the Museum Bluffs Parkview Condominium Owners Association, Museum Bluffs Condos LLC, and owner Russell Smart of Greenville, S.C.

The suit says parking spaces are included as common elements under the master deed and they may not be conveyed without the approval of at least 80 percent of the owners.

It says Mr. Smart continued to sell parking spaces after the complex was turned over to the owners association and included additional parking spaces as incentives to sell some of the last remaining units.

The complaint, filed by attorney John Cavett, said the association failed to take any action against Mr. Smart or to investigate the situation.

It says, Mr. Smart "misappropriated and misrepresented ownership of property owned in common by the members of the Owners Association."

The suit asks for compensatory damages and asks that the association be directed to charge fees for extra parking spaces.
