Criminal Court Judge Rebecca Stern on Monday denied an appeal bond for a man who was given a 12-year sentence for burglary, though his mother said he has long suffered from ADHD (Attention-Deficit Hyperactivity Disorder).
Prosecutor Charlie Minor said many who have that diagnosis have been able to succeed in life. Judge Stern cited a relative who has the diagnosis "and is about to become a lieutenant in the U.S. Army."
The mother said John Lindsey III was not diagnosed with ADHD until he was 19 and by then was far behind.
He was arrested at that age for aggravated robbery and sent to prison for over seven years.
Lindsey was convicted last June on charges of burglary, vandalism and theft and given the new 12-year term.
Judge Stern also denied a request by attorney Lloyd Levitt that Lindsey be moved to Hamilton County so he can work with him on the appeal.
Judge Stern said Lindsey is "very talented and intelligent."
She said he has community supporters, including "Commissioner (Warren) Mackey who came over to see me about it."
But she said Lindsey "has one of the worst theft records I've seen. People have tried to help him all his life, but every time he gets out of jail he picks up new cases."
